We comply with the Digital Millennium Copyright Act (DMCA) of 1998 and respond promptly to valid notices of alleged copyright infringement. This page explains how copyright owners can submit takedown notices and how the process works.

This policy applies to two distinct situations:

  • Reporting infringement of your work that appears on our website โ€” for example, if a user-submitted character on our platform contains your copyrighted artwork
  • Reporting infringement of our work that appears on other websites โ€” for our own enforcement actions

Submitting a DMCA Takedown Notice

If you are a copyright owner (or an authorized agent acting on behalf of one) and you believe that content on Brainrot Characters infringes your copyright, you may submit a written DMCA notice to our designated agent. To be valid under the DMCA (17 U.S.C. ยง 512(c)(3)), your notice must include all of the following elements:

Required elements of a valid DMCA notice

  1. A physical or electronic signature of the copyright owner or an authorized representative.

Notices missing any of these elements may be rejected as invalid under the DMCA.

Our Response Process

Acknowledgment

We will acknowledge receipt of your DMCA notice within 2 business days via email. If you do not receive an acknowledgment within this timeframe, please verify that you sent the notice to the correct address and check your spam folder for our reply.

Review

We will review the notice for completeness and accuracy. Notices that meet all DMCA requirements typically result in content removal within 5 business days of receipt. Complex cases involving disputed ownership, fair use considerations, or platform-wide content may take longer.

Action

If we determine the notice is valid, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material (where applicable) about the takedown
  • Inform the user of their right to submit a counter-notice
  • Confirm the action to you via email

Repeat infringers

In accordance with the DMCA, we maintain a policy of terminating accounts of users who are determined to be repeat infringers. Users who receive multiple valid DMCA takedowns may have their accounts permanently suspended without refund (where paid services exist) and without further notice.

Counter-Notification Procedure

If you are a Brainrot Characters user whose content has been removed in response to a DMCA notice, and you believe the removal was the result of mistake or misidentification, you may submit a counter-notification.

Required elements of a counter-notice

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location at which it appeared before removal (the original URL).
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full legal name, mailing address, and telephone number.
  5. A statement consenting to jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Brainrot Characters may be found, and that you will accept service of process from the person who provided the original notification or an agent of such person.

How counter-notices are processed

Upon receipt of a valid counter-notification, we will:

  • Forward a copy of the counter-notice to the original complainant
  • Inform them that we will restore the material in 10 to 14 business days unless we receive notice that the complainant has filed a court action seeking a court order against you
  • If no court action is filed, restore the material at the end of the waiting period

Submit counter-notices to the same DMCA email address as original notices.

False Claims and Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages. Before submitting a notice or counter-notice, please ensure your claim is accurate and made in good faith.

Common scenarios that do not constitute valid copyright infringement claims:

  • Use of meme characters that exist in public meme culture (the meme characters themselves are not exclusively owned)
  • Use of generic descriptions, common phrases, or short titles
  • Independent creation of similar work without copying
  • Fair use, fair dealing, or other lawful uses of copyrighted material
  • Use of work in the public domain
  • Licensed use under Creative Commons or similar open licenses

User-created characters

Our platform includes a character creator tool that allows users to design their own brainrot characters using AI-assisted art generation. If you submit a DMCA notice regarding a user-created character, please note:

  • The artwork itself was generated by AI tools, which may have implications for copyright ownership
  • The user who created the character may also have a claim to the work
  • We will evaluate notices about user-created characters carefully and may request additional information
  • Removed user-created characters may be restored upon valid counter-notice

Italian Brainrot meme characters

The original Italian Brainrot meme characters (Tralalero Tralala, Bombardiro Crocodilo, Ballerina Cappuccina, and others) originated as viral memes within the broader Italian Brainrot internet community. The characters themselves exist in public meme culture and are not exclusively owned by any single party.

Our specific illustrated interpretations and written character lore are our original creative works. DMCA notices regarding meme characters generally must specify which particular illustration, written passage, or other concrete creative expression is being claimed, not the character concept itself.

AI-generated content claims

Claims that AI-generated content infringes your copyright require additional analysis. We follow current legal guidance on AI-generated work copyrightability and evaluate such claims carefully. If your claim involves alleged AI training on your copyrighted work, please provide specific evidence of how the resulting content reproduces protectable elements of your original work.

What Happens to Removed Content

When we remove content in response to a DMCA notice:

  • The content becomes inaccessible to the public
  • Search engine cached versions may persist for some time and we cannot directly remove them โ€” though Google offers a removal tool you can use yourself
  • Users with the direct URL will see a notice indicating the content has been removed for copyright reasons
  • If a counter-notice is filed and accepted, the content may be restored after the statutory waiting period
  • If repeat infringement occurs, the user account may be terminated
